Welcome to KartUp. These Terms & Conditions ("Terms") govern your use of the website kartup.store (the "Website") and any purchase you make from us. The Website is operated by KartUp, Nerlahadda, Mattigar House, Sirsi, Karnataka 581450, India ("KartUp", "we", "us", "our"). By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least 18 years old, or use the Website under the supervision of a parent or legal guardian, and be capable of entering into a legally binding contract under Indian law.
2. Products and information
- We make every effort to describe and display our products accurately. Colours and appearance may vary slightly due to lighting and screen settings.
- Product specifications are provided for general information. Please read the product description and instructions before use.
3. Pricing
- All prices are in Indian Rupees (INR) and include applicable taxes. Delivery within India is free.
- Prices and availability may change without notice. The price applicable to your order is the price shown at the time you place it.
- If a product is listed at an incorrect price due to a technical or typographical error, we may cancel the order and refund any amount paid in full.
4. Orders
Your order is an offer to buy. We accept it when we dispatch the product and send you a shipping confirmation. We may decline or cancel an order if the product is unavailable, the address is not serviceable, the information provided is incorrect, or we suspect fraud. Any amount paid for a cancelled order is refunded in full.
5. Payments
- We accept payments through UPI, debit and credit cards, net banking and wallets via our secure payment partner Razorpay, and Cash on Delivery where available.
- Online payments are processed securely by Razorpay. KartUp does not store your card or bank details.
- By making a payment you confirm that you are authorised to use the chosen payment method.
6. Shipping, cancellations and returns
Delivery is covered by our Shipping Policy. Cancellations, returns and refunds are covered by our Cancellation & Refund Policy. Both form part of these Terms.
7. Product use and safety
- Use the product only as described in the instructions supplied with it.
- Do not immerse the motor base in water. Clean the jar and blades as instructed.
- Handle the blades with care. Keep the product out of reach of young children and supervise any use by minors.
- KartUp is not responsible for damage or injury caused by misuse, improper cleaning, unauthorised repairs or use contrary to the instructions.
8. Warranty
Products are covered by our 7-day return and replacement policy for damaged, defective or incorrect items, as set out in the Cancellation & Refund Policy. Apart from this, no separate manufacturer warranty is provided unless stated on the product page.
9. Intellectual property
All content on the Website, including the KartUp name and logo, text, images, graphics and design, belongs to KartUp or its licensors and may not be copied, reproduced or used without our written permission.
10. Acceptable use
You agree not to misuse the Website, including by attempting unauthorised access, interfering with its operation, placing fraudulent orders or posting unlawful content.
11. Limitation of liability
To the maximum extent permitted by law, KartUp's total liability for any claim relating to a product or order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms limits any rights you have as a consumer under the Consumer Protection Act, 2019.
12. Privacy
Your personal information is handled in accordance with our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of India. We encourage you to contact us first so we can resolve any concern quickly. Any dispute that cannot be resolved amicably will be subject to the jurisdiction of the courts at Sirsi, Karnataka, without affecting your right to approach a consumer commission under applicable consumer protection law.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and applies to orders placed after that date.
